I'm not sure about this... If the power is off there is no power to support the microphone or any other on board utility, there is no signal, and there is no way it could possibly work haha. This is just a rumor. I know they can tap in if you're on the phone, but if your phone is off they can't. I'm pretty sure if your phone is on and not being used they can't either.

When you turn something like your phone off, it's not *really* off. You can usually determine this by the type of on switch/button on the device. If you've ever looked at a cellphone keypad, the on button only makes contact when you press it. How does your phone know to turn on when you press that button? It's a computer chip that stays on when you turn your phone off. But yeah, it's a news channel--they're paid to lie their asses off.
But your phone is not connecting or connected to a signal when it is off. Hence why the "searching for network" prompt arises when you turn on your phone. Therefore, unless the government is hardwired to your phone it is impossible to "hack" it when it is off.
