I'm trying to make a dvd out of some videos I made but the software I have doesn't allow me to create custom dvd menu backgrounds so instead of part of my video as the background I'm stuck with a pumpkin patch or a birthday cake please help me.

What software are you using?
I believe that Nero offers their suite as a free trial, so you could download that and then use NeroVision to author your DVD.
